Terms & Conditions (Website & Clinic Services)

Operator: BeautyFULL CMC Pty Ltd t/a BeautyFULL Cosmetic Medical Clinic® (“BeautyFULL CMC”, “we”, “us”, “our”).

1. Definitions & Interpretation
- Services means our non-surgical cosmetic medical and aesthetic services, including consultations, cosmetic injectables, skin rejuvenation, and related products and packages provided in-clinic or via telehealth.
- You/your means the individual accessing the Website and/or booking or receiving Services.
- Clinic Policies means our published booking, cancellation, aftercare and related policies, as updated from time to time.
Headings are for convenience only and do not affect interpretation. “Including” is not limiting. A reference to a law includes any amendment or replacement. - Relevant Jurisdiction means the Australian State or Territory where the BeautyFULL CMC clinic that supplied the relevant Services to you is located. If a claim relates solely to Website use (and not to Services supplied by a clinic), the Relevant Jurisdiction is Queensland.
2. Agreement to Terms & Updates
By accessing the Website, creating a booking, purchasing any Service or product, or otherwise engaging with us, you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy (https://beautyfullcmc.au/privacy-policy), incorporated by reference. If you do not agree, do not use the Website or Services.
We may update these Terms at any time at our discretion. The updated version applies from the “Effective date” above. Your continued use constitutes acceptance.
3. Regulatory & Industry Compliance
We operate in accordance with:
- Australian Consumer Law (ACL) in Sch 2 of the Competition and Consumer Act 2010 (Cth).
- Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
- Ahpra requirements and the National Law, including advertising guidance for regulated health services.
- TGA advertising rules (including restrictions on prescription-only medicines and therapeutic claims).
We do not advertise prescription-only brand names. Website information is general in nature, not medical advice, and not a substitute for a consultation with a qualified practitioner.
4. Eligibility, Minors & Capacity
You must be 18+ to book or receive cosmetic injectable Services.
Website access is intended for users 18+; if you are under 18, you warrant your parent/guardian’s consent and they accept responsibility for your use. By booking, you warrant legal capacity to enter this Agreement.
5. Website Access, Accuracy & Acceptable Use
5.1 Accuracy & availability. We use reasonable efforts to keep Website content accurate and available but do not warrant it is complete, current, uninterrupted or error-free. Content may change without notice.
5.2 No commercial use. The Website is for personal, non-commercial use only.
5.3 Prohibited conduct. You must not: (a) breach any law; (b) infringe IP, privacy or publicity rights; (c) defame, harass or mislead; (d) access, monitor or copy using robots, spiders, scrapers or similar; (e) conduct denial-of-service or load testing; (f) introduce viruses, malware, logic bombs or other harmful code; (g) attempt to gain unauthorised access; (h) circumvent security or authentication; (i) use manual processes to copy content without consent; (j) frame, mirror or deep-link except as permitted; or (k) use the Website to advertise, solicit or compete without our written consent.
We may suspend or restrict access at any time to protect the Website or comply with law.
6. Accounts, Portal & Security (if offered)
You may be able to create an online account/portal to manage bookings. You must provide accurate information, keep credentials confidential, and are responsible for all activity under your account. We may suspend or terminate an account on reasonable grounds (e.g., suspected misuse, security risk, legal requirement). You may close your account by written request; closing does not affect accrued obligations.
7. Medical Advice, Suitability & Consent
7.1 No online medical advice. Website content is educational and general only. Do not rely on it as clinical advice.
7.2 Consultation required. All procedures are subject to consultation, assessment and informed consent. A registered medical practitioner or authorised clinician determines clinical suitability, treatment options and dosing (where relevant). We may decline treatment where clinically inappropriate or unsafe.
7.3 Disclosure. You must disclose accurate and complete medical history, medications (including anticoagulants), allergies and prior procedures. Failure to disclose may increase risk and may void any remedy.
7.4 Results & risks. Outcomes vary. No guarantee is made. Risks (e.g., bruising, swelling, asymmetry, vascular and other complications) will be discussed in consultation. You agree to follow all aftercare instructions.
8. Bookings, Deposits, Cancellations, Late & No-Shows
8.1 Deposits. A minimum $50 booking deposit is required for all procedure/treatment bookings and is credited toward the appointment fee.
8.2 48-hour policy. Provide at least 48 hours’ notice to cancel or reschedule. Changes with less than 48 hours’ notice or failure to attend will result in forfeiture of the deposit.
8.3 Confirmation & changes. A booking is confirmed when the deposit is received and we issue confirmation. We may refuse or reschedule at our discretion (e.g., practitioner availability, clinical reasons).
8.4 Late arrival. Late arrivals may reduce consult/treatment time or require rebooking; deposit may be forfeited.
8.5 No-show. We may require prepayment for future bookings following a no-show.
9. Pricing, Payment, Refunds & Recovery
9.1 Pricing. Prices are in AUD and may change at any time (current pricing is shown on our Website/Clinic). We may correct pricing errors and adjust or refund affected orders/appointments at our discretion.
9.2 Payment. Payment is due immediately before or after your appointment. Accepted methods: Cash, EFTPOS, Visa, Mastercard, AMEX, Bank Transfer, Osko, Contactless, Apple Pay, Google Pay, Afterpay, Zip Pay, Zip Money (third-party terms apply).
9.3 GST. Prices include GST where applicable.
9.4 Refunds. Subject to the ACL, change-of-mind refunds are not offered for completed Services. If a Service fails to meet a consumer guarantee, we will provide an ACL remedy.
9.5 Chargebacks. You agree not to make a payment dispute/chargeback without first contacting us to allow investigation and (if applicable) an ACL remedy.
9.6 Recovery. If amounts remain unpaid, you agree we may charge interest on overdue amounts at the Reserve Bank of Australia (RBA) cash rate target + 6% per annum, calculated daily and compounding monthly, and recover reasonable enforcement, collection and legal costs on a full indemnity basis. We may suspend Services until payment is received.
10. Packages, Promotions, Gift Cards & Vouchers
10.1 Packages are personal to you, not transferable, not redeemable for cash, and must be used within the validity period. Packages cannot be split across multiple individuals.
10.2 Promotions are subject to offer terms and may be withdrawn or varied at any time. Promotions may not be combined unless stated.
10.3 Gift cards/vouchers are redeemable for eligible Services/products at our Clinic, are non-refundable, and expire 3 years from issue unless otherwise required by law.
11. Products & Online Sales (if offered)
11.1 Orders & acceptance. Your order is an offer to buy. We may accept or reject any order (e.g., stock availability, pricing error). Title passes on full payment; risk passes on delivery.
11.2 Shipping. Delivery options, timeframes and costs are set out in our Shipping Policy (if applicable).
11.3 Returns. For product returns, see our Returns Policy (if applicable). ACL consumer guarantees apply in addition to any policy.
11.4 Digital items/licences (if any). Where digital content is supplied, you receive a non-exclusive, non-transferable licence for personal use only.
12. Aftercare, Adverse Events & Complaints
12.1 Aftercare. Follow all aftercare provided by our clinicians. Contact us promptly with any concerns.
12.2 Adverse events. If you experience symptoms of a suspected complication, contact the Clinic immediately or seek urgent medical attention (000 in an emergency).
12.3 Complaints. Email [email protected]. We will respond in a timely manner. You may also contact the relevant state health complaints body (e.g., Office of the Health Ombudsman (QLD) or Health Care Complaints Commission (NSW)).
13. Intellectual Property & Clinic Content
The Website, content, text, logos, images, videos, artwork, graphics and trade marks are owned by or licensed to BeautyFULL CMC and protected by Australian IP laws.
- We grant you a limited, revocable licence to view the Website for personal, non-commercial use.
- You must not copy, adapt, reverse-engineer, frame, scrape, publish, transmit or exploit any content without our prior written consent, nor remove proprietary notices.
- No rights are transferred to you except as expressly stated.
14. Reviews, Testimonials & User Content
Where submissions (e.g., reviews) are allowed:
(a) you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display such content for lawful purposes;
(b) you warrant you own/control the rights and the content is truthful and lawful;
(c) you agree content must comply with Ahpra/TGA advertising rules (including restrictions on testimonials and claims about prescription-only medicines).
We may moderate/remove content at our discretion or where required by law.
15. Third-Party Platforms & Links
We may reference third-party sites/services (e.g., payment providers). We do not control and are not responsible for third-party content, availability, security or privacy practices. Your use is at your risk and subject to third-party terms.
16. Privacy, Health Information & Communications
16.1 Privacy. We handle personal and health information per our Privacy Policy and applicable law (Privacy Act 1988 (Cth), APPs).
16.2 Health records. Clinical records are maintained as required by law and professional standards.
16.3 Electronic communications. You consent to email/SMS for booking, clinical and administrative matters. You may opt out of non-essential marketing at any time.
16.4 Cross-border services. Some service providers may be located outside Australia; we take reasonable steps to ensure appropriate protections.
17. Telehealth & Electronic Risk
Where telehealth is used, you acknowledge limitations inherent in remote consultations. We are not liable for interruptions, delays, data loss or security events arising from networks or devices outside our control.
18. Disclaimers & Limitation of Liability
18.1 General. To the maximum extent permitted by law, the Website and content are provided “as is” and “as available.” We do not warrant uninterrupted or error-free access.
18.2 Clinical. We provide Services with due care and skill. Subject to the ACL, we exclude all liability for indirect, consequential, special or punitive loss, loss of data, goodwill, revenue or profit, or loss arising from failure to follow aftercare.
18.3 ACL. Nothing in these Terms excludes, restricts or modifies non-excludable ACL rights. Where liability cannot be excluded but may be limited, our liability is limited (at our option) to resupplying the relevant Services or paying the cost of having them resupplied.
18.4 Cap. To the extent permitted by law, our aggregate liability to you for any claim connected with the Website or Services is limited to the amount paid by you for the Service giving rise to the claim.
19. Indemnity
You indemnify and hold harmless BeautyFULL CMC, its officers, employees and contractors from and against all loss, claims, damages, costs and expenses (including legal costs on a full indemnity basis) arising from your breach of these Terms, unlawful conduct, or misuse of the Website or Services.
20. Force Majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control (including illness of key personnel, supply chain failures, utility interruptions, extreme weather, epidemics/pandemics, or government directions).
21. Suspension, Termination & Enforcement
We may suspend or terminate Website access, cancel a booking or decline to provide Services where necessary to protect safety, comply with law, manage operational risk, or where you breach these Terms. We may take appropriate legal action (including notifying regulators and law enforcement) in response to unlawful use. Accrued rights and obligations survive termination.
22. Governing Law & Disputes
These Terms are governed by the laws of Australia and the laws of the Relevant Jurisdiction, without giving effect to conflict-of-law rules. Each party submits to the non-exclusive jurisdiction of the courts of the Relevant Jurisdiction and, to the extent permitted by law, the courts of the Australian State or Territory where you ordinarily reside. Before commencing proceedings (other than urgent injunctive relief), the parties will use good-faith efforts to resolve disputes, including senior-level discussion or mediation.
23. Notices
We may give notices by email to the most recent address you provided or by posting on the Website (where appropriate). Notices take effect when sent or posted (unless a bounce-back indicates non-delivery). You are responsible for keeping your contact details current. You may send notices to [email protected] or by post to our Clinic address above.
24. Assignment & Subcontracting
We may assign or subcontract our rights and obligations under these Terms, provided this does not materially prejudice your ACL rights. You must not assign your rights without our prior written consent (not to be unreasonably withheld).
25. Severability, Waiver & Entire Agreement
If any provision is invalid or unenforceable, it will be read down or severed and the remainder continues in force. A failure to exercise a right is not a waiver. These Terms (together with the Privacy Policy and Clinic Policies) constitute the entire agreement between the parties about their subject matter.
26. Photography, Media & Training
26.1 Clinical imaging. We may take clinical photographs for your medical record and treatment planning. Any use for education or marketing requires separate written consent.
26.2 Training & supervision. Where lawful and appropriate, some Services may be performed by or in the presence of practitioners under supervision. You will be informed where relevant and may decline.
